Terms of Service

These Terms of Service ("Terms") govern your access to and use of imecase.com and any related services (collectively, the "Service"), operated by Just Live Clean, L.L.C. ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.

1. The Service

imecase.com is the practice-management platform of Just Live Clean, a medical-legal practice conducting Independent Medical Examinations (IMEs), workers' compensation and personal injury evaluations, and — where clinically appropriate — ongoing treatment and chronic-condition maintenance.

The Service includes the public website, authenticated staff tools, and a secure portal through which claimants, patients, referring parties, and authorized representatives may receive notifications, review scheduling and case information, exchange communications, make payments, and sign documents.

2. Eligibility

You may use the Service only if you are:

  • At least 18 years old, or a minor accessing the Service with the permission and under the supervision of a parent or legal guardian; and
  • Accessing the Service for a lawful purpose related to a matter in which you are a claimant, patient, authorized representative, referring party, or authorized user of the practice.

The Service is not offered to the general public as a consumer product.

3. Your Account and Access

3.1 Authentication

Most features of the Service require you to authenticate with a user account or a secure access token we provide. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

3.2 Accuracy of Information

You agree to provide accurate, current, and complete information when using the Service (for example, in intake forms) and to keep that information up to date.

3.3 Authorized Users Only

Do not allow anyone else to use your credentials. If you believe your account has been accessed without authorization, notify us immediately using the contact information in Section 15.

3.4 Claimant vs. Patient Status

Your relationship with Just Live Clean may be as a claimant (evaluation only), a patient (in treatment or maintenance), or both at different times. The nature of that relationship — including any doctor-patient relationship, confidentiality, privilege, and the recipients of reports or records — is described in our Privacy Policy and in the specific consent forms you sign. By using the Service you acknowledge that:

  • An IME or evaluation does not create a doctor-patient relationship and does not carry doctor-patient confidentiality or privilege; and
  • Treatment or maintenance as a patient is a separate relationship with its own informed-consent framework.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Impersonate another person or misrepresent your authority to access a case or record.
  • Attempt to gain unauthorized access to any account, system, or data.
  • Interfere with or disrupt the integrity or performance of the Service (for example, by scraping, probing for vulnerabilities without authorization, or transmitting malware).
  • Reverse-engineer or attempt to derive the source code of the Service, except to the extent such restriction is prohibited by law.
  • Upload or transmit content that is defamatory, infringing, or otherwise unlawful.
  • Use the Service to send unsolicited communications or harvest information about other users.

We may suspend or terminate access for violations of this section.

5. Communications

By providing your phone number or email address, you consent to receive appointment-related and case-related communications from us through those channels, consistent with our Privacy Policy and the specific consents you grant at intake. You may revoke consent to SMS communications at any time by replying STOP, by updating preferences in the portal, or by contacting us.

Message and data rates may apply to SMS messages.

We do not record phone calls. We do not include sensitive health information in SMS messages; the secure portal is the preferred channel for substantive communication.

6. Intellectual Property

6.1 Our Content

The Service, including its software, design, text, graphics, logos, and other content (excluding content you submit) is owned by or licensed to Just Live Clean and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for the purposes described in these Terms.

6.2 Your Content

You retain ownership of information you submit through the Service (for example, intake responses, uploaded documents, signed forms). You grant us a license to use that content as needed to operate the Service, deliver care, conduct the evaluation you were referred for, produce any required report, process claims, and comply with law.

6.3 Feedback

If you provide suggestions or feedback about the Service, you grant us the right to use that feedback without restriction or compensation to you.

7. Medical and Legal Disclaimer

The Service is a practice-management platform. It supports clinical care and evaluation provided by licensed clinicians; it does not itself provide medical advice, diagnosis, or treatment.

In emergencies — if you believe you are experiencing a medical emergency, call 911 or your local emergency number. Do not use the Service to communicate urgent or emergent clinical information.

Content communicated through the Service (including clinical notes, reports, and messages) is part of a clinical or medical-legal process and should be interpreted only in the context of the underlying professional relationship. IME reports are prepared for the referring party and are not a substitute for treatment from your own healthcare provider.

8. Billing and Payments

Where you pay us directly for services, payments are processed by a PCI-compliant payment processor (currently Authorize.net). We do not store full card data. You are responsible for charges incurred on your account and for providing accurate billing information.

For services billed to a payer (insurer, workers' compensation carrier, attorney, or other responsible party under a fee agreement), billing follows the terms of the applicable engagement or insurance arrangement.

If a payment is declined or a claim is denied, you may remain responsible for the balance consistent with the underlying engagement and applicable law.

9. Third-Party Services

The Service uses third-party services to operate (including AWS for hosting and email, Claim.MD for clearinghouse functions, Twilio for SMS and voice transmission, and Authorize.net for payments). Your use of the Service may be affected by those services. We are not responsible for the independent acts or omissions of third parties, but we require HIPAA Business Associate Agreements where applicable and described in the Privacy Policy.

External links from the Service are provided for convenience. We are not responsible for the content or practices of external sites.

10. Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, share, and protect information about you. By using the Service, you acknowledge the terms of the Privacy Policy.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE AGAINST ALL THREATS.

Nothing in this section limits rights granted to you by law that cannot be waived.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUST LIVE CLEAN AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, the above limitations apply to the fullest extent permitted.

This section does not limit liability for clinical malpractice, for which separate professional insurance and legal frameworks apply.

13. Indemnification

You agree to defend, indemnify, and hold harmless Just Live Clean and its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from (a) your breach of these Terms, (b) your misuse of the Service, or (c) your violation of any law or rights of a third party.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time.

Termination does not terminate our obligation to retain clinical records consistent with applicable law, nor does it terminate the privacy protections described in the Privacy Policy.

15. Electronic Signatures and Records

You consent to sign documents electronically through the Service and to receive records and notices electronically. Electronic signatures are valid and binding under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN) and applicable state law. You may withdraw consent to electronic records by contacting us, though certain records may still be delivered electronically where law permits.

16. Changes to the Terms

We may update these Terms from time to time. When we do, we will post the updated Terms at app.imecase.com/tos and update the "Last Updated" date. Continued use of the Service after the update constitutes acceptance of the updated Terms. Where a change materially affects your rights, we will provide additional notice consistent with applicable law.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-laws principles.

Any dispute arising from or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking injunctive relief to protect intellectual property or confidentiality.

Nothing in this section limits any rights you have under HIPAA or other law that cannot be waived.

18. Miscellaneous

  • Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
  • No Waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
  • Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • Entire Agreement. These Terms and the Privacy Policy, together with any signed intake forms, consents, and fee agreements, are the entire agreement between you and us regarding the Service.
  • Headings. Headings are for convenience only and do not affect interpretation.
